Welcome to Garden Maintenance Southwark. By engaging our services, you agree to adhere to the following terms and conditions. Please read them carefully to ensure a clear understanding of our mutual responsibilities.
1. Services Provided
We offer a range of garden maintenance services, including but not limited to:
- Regular lawn mowing and edging
- Pruning and trimming of hedges and shrubs
- Weeding and garden bed maintenance
- Tree care and maintenance
- Planting and seasonal flower bed setup
- Garden clean-up and debris removal
2. Service Agreement
By entering into a service agreement with us, you agree to the following terms:
2.1 Duration
The service agreement is valid for an initial period of one year, commencing on the start date agreed upon by both parties. It may be renewed upon mutual consent.
2.2 Scheduling
Services will be scheduled on a weekly, bi-weekly, or monthly basis, depending on the client's preference and the nature of the garden.
3. Payment Terms
Payment for services is due as follows:
- Invoices are issued monthly and are payable within 14 days of receipt.
- Accepted payment methods include bank transfer, credit card, and direct debit.
- Late payments may incur a 5% late fee per month.
4. Client Responsibilities
Clients are expected to:
- Provide clear access to the garden area during scheduled service times.
- Inform us of any specific garden requirements or areas requiring special attention.
- Ensure that pets and children are kept away from work areas for safety.
5. Cancellation and Termination
Either party may terminate the service agreement under the following conditions:
- Written notice must be provided 30 days in advance of termination.
- In cases of breach of contract, immediate termination may occur with appropriate notice.
- Refunds for prepaid services will be calculated on a pro-rata basis upon termination.
6. Liability
While we strive to provide excellent service, Garden Maintenance Southwark will not be held liable for:
- Damage to plants or property resulting from natural growth patterns.
- Pre-existing conditions or issues not reported prior to service commencement.
- Unforeseen events such as severe weather conditions.
7. Insurance
We maintain comprehensive liability insurance to cover any accidental damages that may occur during service delivery. Proof of insurance is available upon request.
8. Changes to Terms and Conditions
Garden Maintenance Southwark reserves the right to modify these terms and conditions at any time. Clients will be notified of any changes at least 30 days prior to implementation.
9. Governing Law
These terms and conditions are governed by the laws of England and Wales. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts in Southwark.
10. Confidentiality
All client information and garden layouts will be treated with strict confidentiality and will not be disclosed to third parties without explicit consent, except as required by law.
11. Force Majeure
Garden Maintenance Southwark shall not be liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, or government restrictions.
12. Amendments
Any amendments to this agreement must be made in writing and signed by both parties to be considered valid.
13. Severability
If any provision of these terms and conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms and conditions will otherwise remain in full force and effect.
14. Entire Agreement
These terms and conditions constitute the entire agreement between the client and Garden Maintenance Southwark, superseding any prior agreements or understandings, whether written or verbal.
15. Acceptance
By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
